கட்டாயமாக பெண்கள் நிகாப் அணிய வேண்டும் - இதுவே உலமா சபையின் நிலைப்பாடு - ரிஸ்வி முப்தி

பெண்கள் நிகாப் அணிவதை ஜம்இய்யதுல் உலமா வாஜிப் என்பதாக கருதுகிறது. கட்டாயமாக பெண்கள் நிகாப் அணிய வேண்டும் என 2007 இல் வெளியிட்ட பத்வாவின் அடிப்படையிலான நிலைப்பாட்டிலேயே அகில இலங்கை ஜம்இய்யதுல் உலமா இன்னும் உள்ளது என அதன் தலைவர் அஷ்ஷெய்க் ரிஸ்வி முப்தி குறிப்பிட்டார்.
அத்துடன் நிகாபை தடை செய்வதற்கு யாரேனும் முற்பட்டால் அதற்கெதிராக போராட வேண்டியது பாராளுமன்றத்தில் உள்ள 21 முஸ்லிம் எம்.பி.க்களினதும் ஏனைய சகல முஸ்லிம்களினதும் கடமையாகும் என்றும் அவர் வலியுறுத்தினார்.
கடந்த 23.09.2016 வெள்ளிக்கிழமை கொள்ளுப்பிட்டி ஜும்ஆ பள்ளிவாசலில் நிகழ்த்திய குத்பா பிரசங்கத்திலேயே அவர் இதனைக் குறிப்பிட்டார். அதில் அவர் மேலும் குறிப்பிடுகையில்,
உலகத்தில் பெண்கள் முகத்திரை அணியும் விடயத்தை ஒரு சர்ச்சையான வியடமாக மாற்றி விமர்சித்துக் கொண்டிருக்கும் கால கட்டத்தில் நாம் வாழ்ந்து கொண்டிருக்கிறோம். உலகத்தில் குறிப்பிட்ட சில நாடுகள்தான் நிகாபை தடை செய்திருக்கின்றன. ஆனால் உலகின் பல நாடுகளில் இதனை வரவேற்கிறார்கள். கண்ணியப்படுத்துகிறார்கள்.
நிகாப் அணியும் உரிமை வழங்கப்பட வேண்டும் என்று சொல்கிறார்கள்.
இமாம் ஷாபியீ அவர்களுடைய கிரந்தங்களின் அடிப்படையிலேயே இந்த நாட்டின் வக்பு சட்டம், முஸ்லிம் விவாக விவாகரத்துச் சட்டம் என்பன இயற்றப்பட்டுள்ளன. ஜம்இய்யதுல் உலமாவும் தனது பத்வாவை வழங்கும் போது தன்னிச்சையாக செயற்படுவதில்லை. அதற்கும் ஒரு கோட்பாடு இருக்கிறது. 1924 இலிருந்து உலமாக்கள் பத்வாக்களை ஷாபியீ மத்ஹபின் அடிப்படையிலேயே வழங்கி வருகிறார்கள்.
யுத்தம் நடைபெற்ற 30 வருட காலத்திலும் இலங்கையில் நிகாபை அணிந்த பெண்கள் இருக்கிறார்கள். நிகாப் அணியாத பெண்களும் இருக்கிறார்கள்.
அந்த அடிப்படையில் 2007 இல் ஜம்இய்யதுல் உலமா தனது பத்வாவை வழங்கியிருக்கிறது. அதற்கமைய பெண்கள் நிகாப் அணிவதை ஜம்இய்யதுல் உலமா வாஜிப் என்பதாக கருதுகிறது. கட்டாயமாக பெண்கள் நிகாப் அணிய வேண்டும் என்ற அந்த நிலைப்பாட்டையே ஜம்இய்யதுல் உலமா எடுக்கிறது.
இதை நான் பெப்ரவரி மாதம் 5 ஆம் திகதி சம்மான்கோட்டை பள்ளிவாசலில் பிரசங்கம் நிகழ்த்தும்போதும் மார்ச் மாதம் 11 ஆம் திகதியும் ஜூலை மாதத்தில் பேசியதும் இன்று பேசுவதிலும் எந்தவிதமான மாற்றுக் கருத்தும் கிடையாது. இதில் நாம் மிகத் தெளிவாக இருக்கிறோம். நிகாப் என்பது வாஜிபானது. அது கட்டாயமானது.
இந்த நாட்டில் நிகாபை எதிர்க்கக் கூடியவர்கள் எவருமே இருக்கமாட்டார்கள். பெண்கள் தமது மானத்தை கண்ணியத்தை பாதுகாக்க வேண்டும் என்பதில் எல்லோரும் ஒருமித்த கருத்திலேயே இருக்கிறார்கள். ஆனால் அதேநேரத்தில் மாற்றுக் கருத்துள்ளவர்களையும் மதிக்க வேண்டும் என்ற நிலைப்பாட்டை ஜம்இய்யதுல் உலமா தன்னுடைய ஒற்றுமைப் பிரகடனத்தில் வலியுறுத்தியிருக்கிறது.
2007 இல் நாம் ஷாபியீ மத்ஹபின் அடிப்படையில் நிகாப் வாஜிப் எனும் பத்வாவை வெளியிட்ட அகில இலங்கை ஜம்இய்யதுல் உலமா, 2009 இல் வெளியிட்ட ஒற்றுமைப் பிரகடனத்துக்கு அமைவாக மாற்றக் கருத்துக்களையும் மதித்து நடக்குமாறு வலியுறுத்துகிறது.
எனினும் நிகாப் விடயத்தில் 2007 இல் வெளியிட்ட பத்வாவுடைய அதே நிலைப்பாட்டில்தான் இருக்கிறது என்பதை வலியுறுத்துகிறது. நிகாப் என்பது இஸ்லாமிய அடையாளமாக இன்று காட்சியளிக்கிறது.
இதற்கு எதிராக யாரேனும் சட்டங்களை கொண்டு வந்தால் முஸ்லிம்கள் அதனை தன்னுடைய உரிமையாக எடுத்து அதற்காக போராட வேண்டும். எங்களுக்கிடையில் நிலவும் சண்டை சச்சரவுகளை இன்றோடு விட்டுவிட வேண்டும் என்பதற்காகத்தான் இரண்டாவது தடவையாகவும் இந்த விடயத்தை குத்பாவில் குறிப்பிடுகிறேன்.
இந்த விடயத்தை வட்ஸ் அப்களிலும் ஊடகங்களிலும் பேசுவதையும் இதை வைத்து ஒருவருக்கொருவர் மோதிக் கொள்கின்ற நிலை ஏற்படுவதையும் தவிர்த்துக் கொள்ள வேண்டும்.
இந்த நாட்டிலே அதானுக்கு ஏற்பட்டது போன்ற ஒரு சோகமான நிலைமையை ஏற்படுத்த வேண்டாம் என்ற எச்சரிக்கையையும் இந்த இடத்தில் உங்களுக்கு விடுக்க விரும்புகிறேன் என்றும் அஷ்ஷெய்க் ரிஸ்வி முப்தி மேலும் குறிப்பிட்டார்.

ReplyDeleteஜப்னா முஸ்லிமும் உலக்கை சபையின் ஊதுகுழல்தானே அதுதான்ஐவரின் இடுகையினை இருட்டடிப்பு செய்துள்ளனர். கருத்துக்கு இடமளிப்பின் அதனை பதிவிடவேண்டும் ஏன் பதிந்ததனை மறைக்க வேண்டும் .ஒரு பக்கம் சாய வேண்டாம்

ReplyDeleteJaffna Muslim thinks that by removing our comments, they can blackout our opinions. Don't forget that there are hundreds of news websites in Tamil and English in Sri Lanka where we can post our opinions. This is stupidity.
ReplyDeleteAt least these comments are posted and then removed. The comment i left last week is not even here. I don't think Jaffna Muslim is doing the right thing. Anyway, I want to re-post my opinion again expecting Jaffna Muslim would publish it.
ReplyDeleteI see it as a Hippocratic in calling the veil as wajib and then saying we respect the alternative stands also. If veil is wajib, those who doesn't do it are in Sin, and are in rejection of divine guidance - Isn't it hypocritical to calling others to join hand just to get their interests protected. would they join hands with others on a matter which they don't in agreement with.
Also, Muslim women are facing pathetic situations, just because our community as a whole failed miserably to develop our own core intellectuals and professionals. One good example was that a veiled Muslim pregnant women had to undergo physical abdominal examination by male gynecologist in front of a team of interns. this happened last week and does happen on a continuing basis. The women is not the one to blame, it's the Muslim society as a whole and sin is upon us.
My opinion is that the very 1st layer of veil should be on the hearts and minds of both men and women. without that no point of declaring any veil as Wajib. Our Ulema should focus more on developing that.
Also, having well qualified gynecologist is a fald kifaya on all of us, I wonder what ACJU has done to accomplish that. studying in a Sri Lankan university with a veil is almost the impossible thing to do and reaching upto a level of specializing in gynecology is not at all possible. Sri Lanka is a country where majority of the gynecologist are male and women (even non Muslim) are literally held out from qualifying as gynecologists at the final one to one evaluation stage, which is done by senior doctors/professors who are mostly male.
Also, having a veil also comes with another rule, which a women is not suppose to travel without a Mahram. How come a girl in veil suppose to accomplish this. I really wonder why our society is so forward to levy undue restrictions and shed crocodile tears when the real issues comes.
I think my comment is fully justifiable and does not violate any of the Jaffna Muslims rules to deny publishing.
