முஸ்லிம்களுக்கு எதிராக ஞானசாரரின் வெறுப்பூட்டும் பேச்சுக்கு எதிராக முறைப்பாடு - 2 முத்த சிங்கள சட்டத்தரணிகளும் உதவினர்



பொதுபல சேனாவின் பொதுச்செயலாளர் ஞானசார தேரருக்கு எதிராக பொலிஸ் தலைமையகத்தில் முன்னாள் மேல் மாகாண சபை உறுப்பினருமான அர்ஷாட் நிஸாம்தீனால் நேற்று (22) முறைப்பாடு செய்யப்பட்டது. ஞானசார தேரர் அண்மையில் தனியார் தொலைக்காட்சி நிகழ்ச்சி ஒன்றில், உயிர்த்த ஞாயிறு தாக்குதலின் பிரதான சூத்திரதாரி அல்லாஹ் தான் என்று தெரிவித்த கருத்து தொடர்பில் அவரால் குறித்த முறைப்பாடு செய்யப்பட்டுள்ளமை குறிப்பிடத்தக்கது.

Former Western Provincial Councillor Arshard Nizamdeen made two complaints,  today at Police Headquarters, against the recent hate speeches made by BBS General Secretary Ven. Ganassara Himi in two television chennels, Hiru and ITN.

Complainant Arshad Nizamdeen  was accompanied and assisted by two senior lawyers namely Manjula Pathiraja AAL and Namal Rajapaksa AAL.

RACIALLY MOTIVATE HATE SPEECH AGAINST MUSLIMS OF SRI LANKA BY GALAGODATHTHE GNANASARA THERO.

The purpose of this letter is to bring into limelight the conduct and racially motivated statements that amounts to hate speech, made by Ven. Galagodatte Gnanasara Thero on television on the 12th and 13th of September 2021, broadcasted via Independent Television Network and Hiru TV network of Sri Lanka respectively. (A CD containing the said broadcasts are marked Y1A and Y1B and attached hereto) 

Gnanasara thero is making the aforementioned statement against the backdrop of the Presidential Commission of Inquiry on the Easter Sunday Attacks recommending the proscription of the Bodu Bala Sena, which is led by said thero and calling for legal action to be instituted against Galagodatte Gnanasara thero. The bodu bala sena has still not pThus, it is obvious that these statements are made by Gnanasara thero while enjoying state impunity.

These statements are malicious in nature and amounts to hate speech aimed at inciting racial and / or religious mistrust and violence against Buddhists, Catholics, and Muslims in Sri Lanka. 

This shows that Gnasara thero is intent upon creating conflict between Buddhists, Catholics and Muslims of Sri Lanka. Gnanasara Thero who had made these statements had previously been produced before the court several times as a suspect for similar offenses and later released on bail and these matters are yet to receive the advice of the Attorney General regarding due course to be taken.

Gnanasara, who expresses his hatred with state impunity, has been previously indicted by the Attorney General under the International Covenant on Civil and Political Rights (ICCPR) Act No. 56 of 2007 for inciting ethnic conflict and his actions. It must be mentoned that Ven. Gnanasara Thero has also been convicted in two previous courts and has been imprisoned accordingly, only to receive a presidential pardon thereafter.

Such statements of this thero are an impediment to the ongoing investigation and administration of justice over the Easter attack. Furthermore, such false statements are part of a concerted effort to prevent the real perpetrators and those responsible for the 21/04/21 incident from being properly brought to justice. 

These statements are offenses under Sections 2(1)(a), 2(1)(b) and 2(1)(c) of the Prevention of Terrorism (Temporary Provisions) Act, No. 48 of 1979. Furthermore, in accordance with the legal advice I have received, this statement violates Articles 3(1) and/or 3(2) of the International Covenant on Civil and Political Rights (ICCPR) Act No. 56 of 2007. These statements are also offences consequent to sections 2(1)(a), 2(1)(b) and 2(1)(c) of the Prevention of Terrorism (Temporary Provisions) Act, No. 48 of 1979. Furthermore, these statements are a violation of Sections 120, 128, 484 and 485 of the Penal Code.

These statements made by Gnanasara thero shows his knowledge of the attacks on Easter Sunday. If Gnanasara thero had such information, he should have disclosed it to the relevant authorities and assisted in the investigation. Failure to do so is an offense under Sections 05(a) and 05(b) of the Prevention of Terrorism (Temporary Provisions) Act, No. 48 of 1979. He further claims to possess knowledge of similar incidents that is set to occur in the future, which is extremely troubling. 

I hereby urge the IGP to take appropriate action against said Ganasara Thero.
